Definitions

For the purposes of this Privacy Policy:

• Account means a unique account created for You upon Your registration to access and use Our Platform, Application, Website, Products, Service or parts of that.
• Platform means mobile Application or app accessible from “petsNmore” and the Website accessible from https://petsnmore.ai.
• Brand means “petsNmore”
• Company (referred to as either “the Company”, “We”, “Us” or “Our” herein) refers to Totus Animalibus Management Technologies Private Limited.
• Device means any device, that can access the Platform, Product or Service, such as a computer, a mobile/cellphone or a digital tablet or any such digital device.
• Personal Data is any information that relates to an identified or identifiable individual and/or Pet.
• Pet or Pets " shall refer to any animal, bird, reptile etc. that User keeps at home or allow into the home, and for the purposes of this Privacy Policy shall include an amphibian, bird, fish, insect, mammal, reptile or any other living creature, who is dependent on the User financially, operationally and/or in any other way, either in whole or in part, and been subject to the Device at the User’s discretion, either solely or jointly with other Users and whose Personal Data is provided by the User.
• Products means accessories, apparel, food, other goods, products and services under the Brand or third party products and services provided or offered on the Platform.
• Service refers to the services or features provided on or through the Platform.
• Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals engaged or employed by the Company to facilitate the Platform and Services, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Platform or Service is used.
• Usage Data refers to data collected either automatically or otherwise, either generated by the use of the Platform or Service or from the Platform infrastructure itself.
• You (referred to as either “Your”, “Yourself”, “User” herein) shall mean and refer to natural and legal individuals, or the company, or other legal entity on behalf of which such individual is accessing or using the Platform.

Collecting and Using Information and Your Personal Data

Personal Data

Supplying personally identifiable information is entirely voluntary. You are not required to register with Us in order to visit Our Platform. However, We offer some Products and Services only to Users/visitors who do register. While using Our Platform, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. You always have the option to not provide information by choosing not to use a particular Service on the Platform. Personally identifiable information may include, but is not limited to:

Accessing, reviewing, changing and deactivating Your account/profile

Once You open an Account, You can review the information You submitted at the stage of registration and change any information, except Your Email ID and mobile number. An option for facilitating such change shall be present on the Platform and such change will be facilitated by the User. If You no longer desire to use Our Products and Services, You may deactivate Your Account by emailing Us at “contact@petsnmore.ai” specifying the same with Your details and We will cancel Your Account registration and You no longer will be able to access the Products and Services which are available only upon registration. If You change any information or deactivate Your Account, We may or may not keep track of Your old information. We may not retain the information You have requested to remove.

Usage Data

Usage Data is collected automatically when using the Platform even from the Users who are not registered as members of this Platform.

Usage Data may include information such as Your Device’s Internet Protocol address (e.g. IP address), browser information, browsing behavior, URL that You just came from (whether this URL is on the Platform or not), which URL You next go to (whether this URL is on the Platform or not), the pages of Our Platform that You visit, the time and date of Your visit, the time spent on those pages, unique Device identifiers and other diagnostic data.

When You access the Platform through any Device, We may collect certain information automatically, including, but not limited to, the type of Device You use, Your Device unique ID, the IP address of Your Device, Your Device operating system, the type of internet browser You use, unique Device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit or access the Platform through any Device.

Tracking Technologies and Cookies

We use Cookies, tracking technologies, analytics, optimization and targeting tools to track the activity on Our Platform and store certain information, to understand how Users engage with Our Platform so that We can analyse and improve it and cater personalized Services, Products and content according to their preferences.

Use of Your Personal Data

Our primary goal in using Your Personal Data is to provide You a safe, efficient, smooth and customised experience. This allows Us to provide Services and features that most likely meet Your needs, and to customise Our Platform to make Your experience safer and easier, to prevent or detect fraud or abuses. Please note that We reserve the right to send You certain Product and Service related communication, considered to be a part of Your Account without offering You the facility to opt-out.
• To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications, regarding Your purchase or updates or informative communications related to the functionalities, Products or Services, including the security updates, when necessary or reasonable for their implementation.
• To conduct internal research on Our users' demographics, interests, and behavior to better understand, protect and serve Our Users.
• To provide You with news, promotional and special offers and general information about other goods, services and events which We offer that are similar to those that you have already purchased or enquired about or might be interested.
• To manage Your requests: To attend and manage Your requests to Us.
• To track Location: Our Platform collects location data to provide essential functionality, including but not limited to tracking Pet walks and generating a timeline of the route taken.
• For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about Our Platform and Service Users is among the assets transferred.
• For Surveys: We may host surveys on Our Platform through external third parties who are the owners and users of Your survey responses. You may choose not to participate in the surveys. In case you participate, anything you expressly disclose in Your responses will be disclosed to such external third party survey creators. Please contact the survey creator directly to better understand how they might use or share Your survey responses.
• For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of Our promotional campaigns and to evaluate and improve Our Platform, Products, Services, marketing strategy and Your experience.

We may share Your personal information in the following situations:

• With external Service Providers: We may share Your Personal data and information with third parties to monitor and analyze the use of Our Platform, to contact You or to provide You certain Products or Services. We may share information with Service Providers who perform services on Our behalf including but not limited to vendors who help Us manage Our online registration process, event organizers, transactional message processors, outside shipping companies, resellers, business associates to fulfill orders, and payment processing companies to process the payment for Products, goods and Services ordered on or through the Platform.
• For Payments: In case a purchase is made by You on Our Platform, you are automatically redirected to the payment gateway website, where all required transaction details (eg. name, credit/debit card number, expiration date, CVV etc.) are captured. At no time during the purchase process or thereafter, do We have access to, or store, Your complete card account information. Also, We do not capture any UserID or passwords at the time of Your payment and You enter this information directly into a bank secure system.
• For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, restructuring, or acquisition of all or a portion of Our business to another company.
• With Affiliates: We may share Your information with Our affiliates, in which case We will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
• With other users: When You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.
• With Your consent: We may disclose Your Personal Data and information for any other purpose with Your consent.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with Our legal obligations (for example, if We are required to retain Your Personal Data to comply with applicable laws), resolve disputes, and enforce Our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Platform, or We are legally obligated to retain this data for longer time periods.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company’s operating offices and in any other places where the Service Providers involved in the storage and processing are located. It means that this information may be transferred to and maintained on computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.

Your consent to this Privacy Policy, followed by Your submission of such information, represents Your agreement to that transfer.

Security of Your Personal Data

Please note that transacting over the internet has inherent risks which can only be avoided by You following security practices Yourself, such as not revealing Account/login related information to any other person and informing Our customer care team about any suspicious activity or where Your Account has/may have been compromised.

If you opt for any product or services provided by any external Service Provider, and while doing so, disclose any information to the external Service Providers, and/or permit them to collect information about You, then their use of Your information is governed by their privacy policy and We are not liable or responsible for the same.

The security of Your Personal Data is important to Us and We treat such data carefully and try to protect it against loss and unauthorized access. We employ many different security techniques to protect such data from unauthorized access. We follow generally accepted industry standards to protect the Personal Information submitted to Us and the information that We have accessed.

However, as effective as encryption technology is, no security system is impenetrable and no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security. By using this Platform, you agree that We will have no liability, whatsoever, for disclosure of Your information including Your Personal Data and information due to errors in transmission or unauthorized acts of third parties.

Occasionally, at Our discretion, we may include or offer third party products or services on Our Platform. Also, Our Platform may contain advertisements and/or links to other applications, websites, resources or contents that are not operated by Us. If you click on a third party link, you will be directed to that third party’s application or site. These third party sites have separate and independent privacy policies. We have no control over and assume no liability or responsibility for the content, privacy policies, terms or practices of any third party applications or sites or products or services.

Changes to this Privacy Policy

We may update Our Privacy Policy from time to time. The most current version of Our Privacy Policy will govern Our use of Your information. You are advised to review this Privacy Policy periodically for any changes on the Platform. Any amendments to this Privacy Policy shall be deemed as accepted by You / the User on their continued use of the Platform.

Translation Interpretation

This Privacy Policy may have been translated and We have made them available to You on Our Platform. You agree that in case of conflict, the original English text shall prevail over the translation in other languages.

Jurisdiction

If you choose to visit the Platform, Your visit, use and any dispute over privacy is subject to this Privacy Policy and the Terms and Conditions of this Platform. In addition to the foregoing, any disputes arising under this Privacy Policy shall be governed by the laws of India & You agree that the courts of Mumbai shall have exclusive jurisdiction.
